1. General Information

These Terms and Conditions ("T&Cs") govern your use of our services and products, including the purchase of wine and membership subscriptions.

2. Products and Services

2.1 Wine Sales

CoBo specializes in selling wine, either directly or through its membership program. Our wines are intended for personal consumption unless explicitly agreed otherwise. Business-to-business (B2B) clients are required to comply with applicable terms, including restrictions on the resale of certain allocations.

2.2 Membership Program

Memberships provide customers with accrued account credit, which can be redeemed for wine purchases. Details include:

  • Fees: Memberships are available on a monthly basis (€300) or annually (€3,600, effectively granting 13 months).
  • Credit System: Membership fees convert to Account Credit on a 1:1 basis and are valid for two years from the date of accrual. For example, credit accrued in January 2024 expires in February 2026.
  • Payment Terms: Monthly memberships are processed via an ING incasso contract. Annual memberships are invoiced like standard orders.
  • Cancellation:
    • Annual memberships can be canceled at any time without a fixed term.
    • Monthly memberships require cancellation at least 14 days before the next incasso.
  • Refunds: Upon cancellation, any paid accrued credit will be refunded. Bonus or promotional credit is non-refundable.

3. Payment Terms

3.1 Payment Methods

Payments can be made via bank transfer, credit card, or PayPal. Bank transfer is the default option.

3.2 Payment Timelines

Payment is generally required upfront due to the sourcing nature of our wine products. Delivery times, as communicated in our offers, are indicative and not binding.

3.3 Refund Policy

  • Unopened bottles can be returned within 30 days of receipt for a full refund.
  • Original cartons (OC) or original wooden cases (OWC) must remain unopened for returns to be accepted.
  • Specialty requests (e.g., aged wines) are non-refundable for issues like corked wines.

4. Shipping

  • Free shipping is offered for orders exceeding €250.
  • Shipping costs for orders below €250 will be included in the invoice.

5. Liability

5.1 Direct Liability

We accept responsibility for damages that could have been reasonably prevented, such as improper packaging. Broken bottles will be refunded unless the cost of replacement is deemed unreasonably high, in which case they will be insured.

5.2 Indirect Liability

CoBo disclaims all responsibility for indirect or consequential damages, including delays caused by third-party carriers or suppliers.

5.3 No Liability Caps

There are no caps on liability amounts unless explicitly stated otherwise.

6. User Responsibilities

6.1 Accurate Information

Customers are required to provide accurate billing and shipping information. Incorrect details may lead to delays or cancellations.

6.2 Prohibited Activities

  • Allocation wines are not intended for resale.
  • Buyers must comply with applicable resale restrictions for specific wine allocations.

7. Data and Privacy

7.1 Data Collection

We collect personal data necessary for invoicing, shipping, and membership management. This data includes but is not limited to names, addresses, and payment details.

7.2 Third-Party Sharing

Personal data is shared with third parties only as necessary for operational purposes, such as providing shipping details to logistics partners.

7.3 Cookies

Our website uses cookies to enhance functionality. No personal data is collected unless explicitly entered by the user.

8. Termination and Changes

8.1 Termination Rights

  • CoBo reserves the right to terminate memberships or cancel orders in case of violations of these T&Cs or non-payment.
  • For memberships, any paid accrued credit will be refunded upon termination, but bonus credit is non-refundable.

8.2 Amendments

We reserve the right to amend these T&Cs. Changes that materially affect users will be communicated via email.

9. Miscellaneous

9.1 Force Majeure

CoBo is not liable for delays or non-performance caused by events beyond our reasonable control, such as natural disasters, strikes, or transportation issues.

9.2 Entire Agreement

These T&Cs constitute the entire agreement between CoBo and its customers, superseding any prior agreements.
